These Terms and Conditions ("Terms") govern your use of the CaterMarket website at www.catermarket.co.uk, operated by Eletiser Ltd ("we", "us", "our"). By using this website or creating an account, you agree to these Terms in full. If you do not agree, please do not use the platform.

1. About CaterMarket

CaterMarket is an online marketplace for the UK catering industry. It enables users to post and browse adverts for catering businesses for sale, commercial premises and kitchens to let, second-hand equipment, and job opportunities. We also publish a Suppliers Directory of trade partners.

CaterMarket is a marketplace platform only. We are not a party to any transaction between buyers and sellers, employers and workers, or landlords and tenants. All transactions and agreements are made directly between users.

2. Eligibility

To register for an account and post adverts, you must:

• Be at least 18 years old
• Be based in or conducting business relevant to the United Kingdom
• Provide accurate and truthful registration information
• Have the legal right to sell, let, or advertise the item or opportunity you are posting

3. User Accounts

You are responsible for maintaining the security of your account password. Do not share your login credentials with anyone. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that are found to be in breach of these Terms, used for fraudulent activity, or inactive for an extended period without notice.

4. Posting Adverts — Permitted Use

When posting an advert on CaterMarket, you agree that:

• All information in your advert is accurate, truthful, and not misleading
• You own or have the legal right to sell, let, or advertise the item or opportunity
• You will not post the same advert multiple times (duplicate listings are removed)
• You will not include personal data about third parties without their consent
• You will update or remove the advert if the item is sold, let, or the opportunity is filled
• Photos you upload are yours to use and do not infringe any third-party copyright

5. Prohibited Content

The following types of content are strictly prohibited on CaterMarket. We will remove any advert and may suspend any account found to contain:

• False, fraudulent, or misleading information
• Adverts for businesses or premises the poster does not have authority to sell or let
• Requests for upfront fees from job applicants (advance fee fraud)
• Stolen equipment or goods
• Content that is discriminatory, offensive, or in breach of UK equality law
• Job adverts that discriminate on the grounds of age, sex, race, religion, disability, or sexual orientation
• Spam, unsolicited marketing, or adverts posted by bots or automated systems
• Any content that is illegal under UK law

6. Advert Review and Moderation

All adverts are reviewed by our team before going live. We reserve the right to approve, reject, or remove any advert at our sole discretion, without being required to give reasons. If your advert is rejected, you will receive an email explaining why and you may resubmit after making changes.

Approval of an advert does not constitute endorsement of the seller, landlord, employer, or the accuracy of the advert's content. We rely on users to provide accurate information.

7. Contact Details and Direct Transactions

CaterMarket operates on a direct-contact model. Sellers, landlords, and employers provide their own contact details (WhatsApp, phone, or email) and buyers, tenants, and job seekers contact them directly.

We are not involved in and accept no liability for any communications, negotiations, agreements, or transactions between users. You are solely responsible for conducting appropriate due diligence before entering into any transaction or employment arrangement found through CaterMarket.

We strongly advise:

• Never pay a deposit or any sum of money without first viewing the business, premises, or equipment in person
• Never pay any fee to an employer before starting work
• Always use a solicitor for business purchase or lease agreements
• Verify business accounts, lease documents, and ownership before committing

8. Pricing and Free Launch Period

During the free launch period, all adverts may be posted at no charge. The free period lasts for three months from the platform launch date. We will give at least 30 days' advance notice before any paid pricing is introduced. Pricing, when introduced, will be published on our Pricing page.

We reserve the right to introduce, modify, or discontinue pricing at any time with reasonable notice. Existing live adverts will not be retrospectively charged without notice.

9. Intellectual Property

The CaterMarket name, logo, design, and all platform content created by us (including layout, code, and copy) are the intellectual property of Eletiser Ltd and are protected by UK copyright law.

By posting an advert, you grant Eletiser Ltd a non-exclusive, royalty-free licence to display, reproduce, and distribute the content of your advert (including photos) on the CaterMarket platform and in promotional materials related to the platform, for as long as the advert is live.

You retain ownership of the content you post. We will not sell or license your advert content to third parties.

10. Limitation of Liability

CaterMarket is provided on an "as is" basis. To the fullest extent permitted by UK law, Eletiser Ltd excludes all liability for:

• Any loss or damage arising from transactions between users
• The accuracy, completeness, or legality of any advert posted by a user
• Any loss arising from reliance on information on the platform
• Interruptions to the service, technical errors, or data loss
• Any indirect, consequential, or special loss of any kind

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by UK law.

11. Third-Party Links

The platform contains links to external websites, including supplier websites in the Suppliers Directory. These links are provided for convenience only. We have no control over the content or practices of external sites and accept no responsibility for them. Visiting any external site is at your own risk.

12. Termination

You may close your account at any time by contacting us at hello@catermarket.co.uk. We will remove your account and adverts within 5 working days.

We may terminate or suspend your account immediately if you breach these Terms, engage in fraudulent activity, or use the platform in a way that is harmful to other users or to us. Termination does not affect any rights or liabilities that have already arisen.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify registered users by email where changes are material. Continued use of the platform after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from your use of CaterMarket will be subject to the exclusive jurisdiction of the courts of England and Wales.
